1. GENERAL TERMS

The Maverick Group and Co., a Sole proprietorship firm, operating from our registered office/ principal place of business at 106/3,Beside Stone hill Govt School, Jala Hobli, Taranhunise Village, Bengaluru, Bengaluru Urban, Karnataka - 562 157 along with its entities, subsidiaries and affiliates (“We”, “Our”, “Us”) through Our stores, Tack Shop, The Tack Room (collectively, “Store(s)”, Our website www.tackshop.in (“Website”) and third party sites sell equestrian tack, apparel products and accessories (“Products”).

These Terms of Use (“Terms”) govern Your access to and use of Our Website, including browsing, purchasing Products, and any related interactions. By using Our Website, You agree to comply with these Terms. Additionally, our Privacy Policy and Cookie Policy outline how we handle your personal information. We request you to kindly review them carefully.
In these Terms, “You” or “Your” refers to any individual who accesses, browses, or makes a purchase on the Website, whether as a guest or a registered customer.
The Terms have been drafted in compliance with the
(i) The Indian Contract Act, 1872;
(ii) The (Indian) Information Technology Act, 2000, and the rules, regulations, guidelines and clarifications framed thereunder, including the
(iii) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);
(iv) Consumer Protection Act, 2019 along with rules framed thereunder, including the
(v) Consumer Protection (E-Commerce) Rules, 2020.
By placing an order through Our Website, you confirm that You have read, understood, and agreed to these Terms. Therefore, before placing an order, You will be asked to accept these Terms. These Terms form a legally binding agreement between You and Us, outlining mutual rights and obligations. If You do not agree to these Terms, You must refrain from using the Website.
We reserve the right to suspend or terminate Your account and/or any order if you violate these Terms.
(c). ABOUT YOU
We can only offer the sale of Our Products if You are at least 18 years of age, or of legal age of majority, and are competent to contract as per Indian laws. We reserve the right to decline or cancel Your order if You are under 18 years of age or are not legally competent to contract under Indian laws.
If a Product is intended for use by a minor, the account must be created and operated by a parent or legal guardian, who shall bear full responsibility for all activities and transactions conducted under the account. All purchases must be made solely by the parent or guardian, and by proceeding with a transaction, they confirm acceptance of these terms and assume full liability for compliance with applicable laws.
Additionally, If you are of legal age and are competent to contract as per Indian laws, You must be purchasing the Product(s) solely for non-commercial use. We reserve the right to decline or cancel Your order if the purchase is being made by resellers or business instead of end customers.
We reserve the right to cancel or suspend any order or account found to be in violation of these terms.
We only supply Products on the Website and in Our Stores for domestic and private use. By ordering from Us, You agree to not use any Product for commercial or business purposes. For Products purchased through Our Stores and Website, We want to highlight that We have no liability to You for any direct or indirect loss of profit, loss of business, business interruption, or loss of business opportunity. By submitting your Order to us, you agree that you are offering to purchase Product(s) exclusively for personal and non-commercial use.
2. PLACING, AMENDING AND CONFIRMING AN ORDER
(a). ORDER
You can submit an order for Products on Our Website by completing the details required on the order summary page and clicking the complete order button. Goods supplied are not for resale. All prices include GST.
We are under no obligation to accept Your order, but would normally do so where the Product is available. Please note that the order reflects current pricing.
The display of any Product on Our Website is in no way an offer by Us to sell to You. It is Your response/order submission to purchase the Product that constitute as an offer. Accordingly, We are not liable to sell You any Product that might be quoted at a price lower than that meant by Us and the order placed by You is subject to these Terms.
(b). ACCEPTANCE OF YOUR ORDER
Place Order:
You place the order for Your desired Products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website;
Order Acknowledgment:
We will send you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from us;
Shipping Confirmation:
As your Product is shipped from our warehouse, we will send you a shipping confirmation email;
Order Acceptance:
Order acceptance and the completion of the contract between You and Us will take place on the dispatch to You of the Product(s) ordered unless We have notified You that We do not accept Your order, or You have cancelled it in accordance with these Terms. The Shipping Confirmation email shall also serve as Your order acceptance.
Risk of loss and title for the Product purchased from the Website passes to You upon delivery of the Products to the carrier. If We do not accept Your order for any reason or the price of the Product has increased between the time of the order and Our acceptance of it (or if a supplementary delivery charge applies), We will email You to advise You of the change. You will then need to resubmit your order.
(C) . HOW TO PAY
Payment for the Products and all applicable delivery charges is in advance. We take every reasonable care to ensure that Your order and subsequent transactions are conducted via a secure link. As We are not responsible for the operation of the secure link We will not be liable for any loss You may suffer if a third party obtains unauthorised access to any information You provide via such link. If Products are not available for any reason after We have received Your order, We will let you know. We will refund any amounts already paid (if any) to your original mode of payment. Refer to clause (a) for more details about payment options.
(d). SECURITY CHECKS
As part of Our policy to protect against fraudulent use of credit / debit cards, we conduct security checks on all orders received. These checks can take various forms and may involve contacting You by telephone before We process Your order. We also procure the services of various credit rating and fraud prevention companies and We may share details of your order with them for the sole purpose of detecting and preventing fraudulent use of Your payment cards (in accordance with our PRIVACY POLICY). Please note we will never ask you to provide us with any OTP or Aadhar Card details over calls.
What is the Cancellation Policy?
You can now cancel an order when it is in packed/shipped status, as long as the cancel option is available on Website. This includes items purchased on sale as well. Any amount paid towards the order will be credited into the same payment mode using which the payment was made.
Can I modify the shipping address of my order after it has been placed?
Yes, You can modify the shipping address of Your order before we have processed (packed) it, by updating it under 'change address' option which is available under ‘My order’ section of the Website.
How do I cancel my Order?
Tap on “My Orders” section under the main menu of Your Website and then select the item or order You want to cancel.
I just cancelled my order. When will I receive my refund?
For payments made via Credit Card, Debit Card, Net Banking, UPI or UPI Wallet you will receive refund into the source account within 10-12 days from the time of order cancellation.
(e). FAULTY PRODUCTS
If you have returned the Products to us because they are faulty or misrepresented or incorrectly described, we will refund the price of a defective Product in full and any applicable delivery charges, provided if you produce a video of unboxing or opening the packaging of the Product.
(f). PRODUCTS EXCLUDED FROM RETURN
Subject to your right to cancel and your statutory rights, some products may be excluded from returns as mentioned under clause 6(c).
3. PRODUCTS INFORMATION
(a).PRODUCTS AND PRICES.
Product information:
We try to ensure that all of the information that You see is correct, however sometimes Our busy teams might miss something, so We may need to amend prices, Product descriptions and promotional codes from time to time. If this affects Your order, we’ll let You know.
Product colours, specific detailing and packaging may vary slightly from Website images. Our Website images are for illustrative purposes only and whilst We make every effort to display detailing and colours as accurately as possible, We cannot guarantee how such colours will display on Your device.
Product prices:
The prices that you see on our Sites include GST, but please be careful to check any other taxes or location specific delivery fees that may be applicable to your Orders.
Product availability:
All Our Products are subject to availability. To be able to keep providing You with all of the new and innovative items that You see, some Products on Our Website may not be available in Stores, and vice versa. We cannot make any representation or warranty that all Products will be available at all time or at all locations. Don’t worry - We will inform and notify You by email as soon as possible if a Product in Your Order is not available and/or We’ve had to cancel your Order, and You will be refunded any respective amount(s) to your original Payment Method.
4. HOW TO PAY
(a). HOW TO PAY.
Acceptable payment methods (each, a “Payment Method”) may vary from time to time and by Website - these will be shown on the “Order Summary” page. Depending on which Payment Method You use, Our payment processor may retain, and We may retrieve, the original payment details of Your order to support related transactions, such as refunds on eligible returns. This is done in accordance with Our Policies
Generally, acceptable payment methods include, but are not limited to, Credit Card, Debit Card, Net Banking, UPI and the tackshop.in gift card (“Gift Card”).
(b). SECURITY CHECKS ON YOUR INFORMATION.
Here at tackshop.in, we want to make sure our Guest’s information is safe. We take reasonable care to ensure your Order and subsequent transactions are conducted via a secure link.
We may also procure the services of fraud prevention companies and we may share details of your Order with them, for the purpose of detecting and preventing fraudulent use of Payment Methods – this is done in accordance with our Privacy Policy.
5. DELIVERY
We aim to make sure Your Order is with You by the estimated delivery timeframes provided in the order confirmation details. However, there may be unforeseen circumstances beyond Our control that could impact delivery timelines.
If an event outside Our control prevents Us from delivering the Products to You by the estimated delivery date/timeframe, We will contact You with a revised estimated delivery date. Either way, You can track Your order via Your account and shipping confirmation email.
How we deliver:
The Products will be delivered to the address that You provide to Us in Your order (on the basis that it is a valid address).
We use several shipping providers across Our Website to deliver Your Orders to You. We aim to use the most appropriate delivery service available in Your region (and certain services may not be available for Us to use).
Once we have received Your Order and We have dispatched the Products, You will be contacted by Us to let You know We’ve confirmed Your Order. You may also be contacted directly by the Shipping Provider to provide You with updates on the status Your Order. We are not responsible for the content or timing of these notifications, including the accuracy and frequency of any email. The Shipping Confirmation email shall also serve as our Order acceptance.
Delivery is completed when the Product is delivered to the address submitted in Your order, at which time the Product(s) become Your responsibility. You own the Products once we have received payment in full (including any delivery charges) so make sure You take reasonable care of them.
We cannot be held liable for any parcels that are lost or stolen as a result of any incorrect or inaccurate delivery instructions that You give to the Shipping Provider.
Split deliveries:
Sometimes, We may need to split Your Order into multiple deliveries to make sure the Products get to You as soon as possible. Delivery practices may vary depending on which Shipping Provider is delivering the Products, but We’ll be sure to select the most appropriate method, depending on the nature and number of the Products that You have ordered. While most products ordered via the Website are shipped to You from our warehouse, some products may be shipped directly from one of Our Stores. Either way, We try to ensure that the Products reach You as quickly as possible.
Damaged and missing Products:
If You notice that any Product You receive is damaged, or in the event any Product(s) is/ are missing from Your order, please reach out to Us via Our contact information.
In the event that Your Order doesn’t get to You (and You believe it has been lost in transit), please contact Us and We will try to look into this for You. Make sure to check any potential safe spaces or with Your neighbours – sometimes Our Delivery Providers will leave Your order in these places to ensure You receive it on the estimated delivery date.
"If you have not received your Order but the tracking information shows it as delivered, please contact Us within 30 days, and We will investigate the issue. If the issue remains unresolved, We will issue a refund or replacement as per our Returns, Refunds, and Repairs Policy."
Risk and title of Products:
Title (which essentially means the ownership of) the Product passes to You upon successful delivery by the Shipping Provider to You. Risk of loss passes to You upon delivery of the Products to You by the Shipping Provider.
6. RETURNS AND REFUNDS POLICY
(a) OUR RETURNS POLICY
This Returns, Refund and Repairs Policy is without prejudice to any right of withdrawal (set out below) or warranties applicable to you. Please see “Right of Withdrawal” and “Warranties, Guarantees and Limitation of Liability” sections below, for more information!
If the products you have purchased is faulty or damaged, you have Three (03) days from the date you received your Order to return such Product to us. You can do this via our online returns portal or by bringing the Product into one of our Stores. Tackshop.in will refund the full price of the defective Product. In some circumstances you may also be offered a repair or replacement. You are legally obligated to take reasonable care of the Products while they are in your possession. Refunds will be issued via the Payment Method of your Order or to a tackshop.in Gift Card.
Conditions for return:
Any returned Product should ideally be carefully stored in its original packaging, used only for the purpose of verifying its nature, specifications, and size, and show no signs of wear or dirt. A video of the unboxing of the Product should be sent. All returned Products must be unwashed with hangtags still attached. We reserve the right to reject any returned Product that does not meet the above-mentioned requirements.
If You’re returning Your Product to Us in Store, please bring proof of purchase, a video of the unboxing/ opening of the Product upon receiving the Product and details about Your original method of payment with You at the time of return. All Products are subject to inspection and We may refuse a refund if We believe that the Product has been used, worn, damaged or soiled by You.
When sending any Product(s) back to Us, We strongly recommend that You obtain and safely store proof of shipping until Your refund is processed. Sometimes, We might ask You for a copy of this to allow Us to track where Your return is! In the event that You are unable to provide proof of shipping and We cannot locate your return, We have the right to refuse a refund for the Product(s).
(b) REFUNDS
For return which qualify, You will receive a full refund of the price You paid for the Product, less any applicable shipping or delivery charges, which are non-refundable where the refund is not resulting from the Product being defective or faulty . We will process the refund as soon as possible, and in any event, within thirty (30) calendar days of the date of receipt of the returned product.

Exchanges/ Replacement:
Unfortunately, We are unable to provide exchanges online due to uncertainty of product availability. If You do want to exchange Your Product(s) for a different size or colour, You will essentially need to return Your original Order back to Us and repurchase the Product in Your new size/colour. Please note that if there is any price difference between the originally purchased product and the new product due to a change in size or colour, the difference must be paid by the customer.
Exchanges may be possible in Our Stores (subject availability). If You do want to try and exchange Your Product, You can head to one of Our Stores and Our friendly team can assist You. Please note – availability of sizes, styles and products varies in each Store so it may not be possible to exchange Your Product. We are not responsible for any costs incurred by You in relation to travelling to/from a store to try and make an exchange.
7. DISCOUNTS AND LOYALTY PROGRAMS
We make available certain discount and loyalty programs for qualifying individuals. These programs are subject to change and may have additional terms and conditions that apply.
Unless otherwise provided for in a separate discount or loyalty program agreement:
(i) we may restrict the Payment Methods used in connection with an applicable discount (for example, a debit or credit card may be required);
(ii) you may not purchase Product with your applied discount with the intent to commercially resell; and
(iii) use and applicability of promotional codes and or discounts is at Our absolute discretion and may be suspended, cancelled and or amended from time to time. Exclusions may apply, including but not limited to use of promotional codes.
We reserves, and you acknowledge and agree that tackshop.in has, the absolute right to deny use of any discount or refuse Orders for any person suspected of reselling or orders which have characteristics of reselling.
8. WARRANTIES, GUARANTEES AND LIMITATION OF LIABILITY AND INDEMNITY.

You shall not transfer or assign Your rights or obligations to another person without our express agreement. We may transfer or assign our rights and obligations under these Terms or appoint third parties to assist Us in performing our obligations at any time, provided that this will not reduce Our obligations to You.
The Contract between you and us is binding.
Limitation of liability:
You expressly understand and agree that We shall not be liable for any indirect, incidental, or consequential damages, including without limitation damages for loss of revenue, profits, use, or data, resulting from any use of the Website and/or the Products (regardless of whether We should have known of the possibility of such damages). To the maximum extent permitted by the applicable law, when You order goods from the Website, Our aggregate liability to You for any loss or damage arising in connection with these Terms shall be limited in respect of each claim, to the purchase price paid towards Your order.
Indemnification:
You agree to defend, indemnify and hold harmless Us, and Our officers, managers, members, directors, employees, successors, assigns, subsidiaries, affiliates, team members, service providers, suppliers, and agents (hereinafter “Representatives”), from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees) arising from Your violation of any provision of the Terms, including the Privacy Policy and
Cookie Policy; Your violation of any third party right, including without limitation any copyright, trademark, proprietary, intellectual property, or privacy right.
Guarantees & Warranties:
We do not guarantee that our Sites will always be available or be free from error, virus or similar.
We may provide links to other websites, including but not limited to third-party Privacy Policy, Terms of Use and Cookies Policy. Where we do this, the links are provided for Your convenience only and we cannot be responsible for the content or availability of those websites or Your use of them.
Although we aim to provide information that is accurate and up to date, we do not guarantee to do so. You are responsible for making sure that your reliance on our Websites is suitable for your own purposes and the information that we provide is not intended to be advice you should rely on. The information contained on our Sites is provided on an "AS IS" basis.
To the fullest extent which the law allows, we exclude all warranties and representations of any kind with respect to our Sites and their contents.
Our Quality Promise is our limited guarantee that the Product you purchase will perform as intended and detailed in each Product’s applicable Product description page on the Website.
Also, we wanted you to know that under these Terms of Sale: Warranty and guaranty claims for all third party products are governed by their individual warranty or guaranty terms & conditions. We shall not be held liable for the same.
YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL ACTS OR OMISSIONS TAKEN OR MADE IN RELIANCE ON THE WEBSITE, INCLUDING INACCURATE OR INCOMPLETE INFORMATION. (b). EVENTS OUTSIDE OUR CONTROL.
We are not liable or responsible for any failure to perform, or delay in performance of, any of its obligations under any contract that is caused by events outside our reasonable control (“Events Outside Our Control”).
An Event Outside Our Control includes any act, event, non-happening, omission, or accident beyond our reasonable control, and particularly includes the following, without limitation:
(a) strikes, lockouts, or other industrial action;
(b) civil commotion, riot, invasion, terrorist attack, threat of terrorist attack, war (declared or not), or threat or preparation for war;
(c) fire, explosion, storm, flood, earthquake, subsidence, or other natural disaster;
(d) impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport;
(e) impossibility of the use of public or private telecommunications networks;
(f) acts, decrees, legislation, regulations, or restrictions of any government; and
(g) pandemic or epidemic.
Our performance under any contract is deemed to be suspended for that period that the Event Outside Our Control continues, and we will have an extension of time for performance for the duration of that period. We will make reasonable efforts to bring the Event Outside Our Control to a close or to find a solution by which our obligations under the Contract may be performed despite the Event Outside Our Control.
9. MISCELLANEOUS
(a). RETENTION OF THE AGREEMENT
For You shopping on our Website, We wanted to let You know that We will retain and archive a copy of all Orders placed by You. You have a right to access these at any time by contacting Us via the info provided in the “Contact Us”.
(b). THIRD-PARTY RIGHTS
This contract is between tackshop.in and you. No other person shall have any right to enforce any terms herein except for any of Our group company.
(c). WAIVER
If either party fails to insist that the other perform any of its obligations under these Terms, or if either party does not enforce its rights against the other party, or delays in doing so, that will not mean that the concerned party has waived its rights against the other and will not mean that the other party does not have to comply with those obligations. If either party waives a default by the other, it will only do so in writing, and that will not mean that it will automatically waive any later default.
(d). LANGUAGE
English shall be the exclusive language of these Terms and any communications, agreements, and proceedings between Us. These Terms have been drafted in English and any translation of these Terms will be for convenience only.
(e). ENTIRE AGREEMENT
These Terms of Use, Privacy Policy, and Cookie Policy, as applicable, constitute the entire agreement, superseding all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between You and Us with respect to our Website.
(f). REVISIONS TO THESE TERMS OF SALE
We may revise these Terms of Sale from time to time. Every time you place an Order, the Terms of Sale in force at that time will apply to your Order upon confirmation by us.
(g). GOVERNING LAW AND JURISDICTION
These Terms of Sale shall be governed by, construed, and enforced in accordance with the law of Bangalore, Karnataka, India.
(h). DISPUTE RESOLUTION
We always try to settle disputes with Customers directly through our Customer Care Team and/ or Grievance Redressal Officer. However, if You are still unhappy with the resolution provided to You, the following option for dispute resolution could be followed.
This Terms (including Privacy Policy and Cookie Policy) shall be governed by and construed in accordance with the laws of India, without giving effect to the principles of conflict of laws thereunder.
Any dispute or difference, whether on the interpretation or otherwise, in respect of any terms hereof (including Terms, Privacy Policy and Cookie Policy) shall be referred to arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996, (the “Act”) as amended or replaced from time to time. A sole arbitrator shall be appointed as per the provisions of the Act and the arbitrator’s decision shall be final and binding on the parties. The seat of arbitration shall be Bangalore, Karnataka and the language of the arbitration shall be English.
Subject to the aforesaid, the Courts at Bangalore, Karnataka shall have exclusive jurisdiction over any proceedings arising in respect of the Terms (including Privacy Policy and Cookies Policy).
